These Terms of Use apply to the HabitSpark website and supplement the terms that govern the HabitSpark iOS app. By using HabitSpark or the website, you agree to these Terms. If you do not agree, do not use HabitSpark or the website.

Free and Pro

HabitSpark includes a free version and a paid Pro version. Free includes timers, history, and your Spark balance. Pro adds Insights, unlimited activities, backup and restore, and custom Spark cap control, along with any other paid features identified in the app or App Store listing.

If a feature requires Pro, the app makes that clear before you try to use it. If you do not purchase Pro, the free version remains available subject to these Terms and any limits shown in the app.

Apple app license terms

Unless a custom app license is provided in the App Store listing, use of the HabitSpark iOS app is also governed by Apple’s Standard End User License Agreement. If there is a conflict between these supplemental terms and Apple’s standard app license for App Store matters, Apple’s app license will control for the iOS app.

Apple, App Store, and StoreKit are trademarks of Apple Inc., registered in the U.S. and other countries and regions.

Using HabitSpark

  • You may use HabitSpark for lawful personal use.
  • You must be old enough to use HabitSpark under the laws of your country, or use it with permission from a parent or guardian.
  • You are responsible for how you use the app and any information you choose to store, export, or share.
  • You are responsible for keeping any exported backup files safe.
  • HabitSpark is intended to support habit and time awareness. It is not medical, therapeutic, mental health, financial, or legal advice.
  • You must not misuse the app or website, interfere with their normal operation, or use them in a way that violates applicable law.

Your content and backups

HabitSpark may let you create activities, session history, settings, and backup files. You keep responsibility for the content you create and any backup files you export, store, import, or share. HabitSpark does not operate a cloud account for your app data and cannot restore data that you delete, lose, or fail to back up. HabitSpark is not responsible for loss of data stored on your device or in backup files.

Intellectual property

HabitSpark, including its name, branding, design, website, and software, is protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse engineer, or interfere with HabitSpark except where permitted by law or Apple’s app license terms.

Purchases and subscriptions

  • HabitSpark Pro purchases are billed by Apple, not by HabitSpark directly.
  • If a HabitSpark Pro purchase renews automatically, Apple shows that before purchase and the subscription continues until you cancel it through your Apple account.
  • The app and App Store listing must show the subscription title, billing period, and price before purchase.
  • Subscription management, renewals, cancellations, and refunds are handled through your Apple account subject to Apple’s rules and policies.
  • If your subscription expires or is canceled, access to paid features may end at the conclusion of the active billing period.

HabitSpark may offer subscriptions and lifetime or one-time purchases. The app and App Store listing will describe the price, billing period, renewal behavior, and what each purchase includes before purchase.

Availability and product changes

HabitSpark may evolve over time. Features may change, improve, or be removed as the product develops. The website and app may also be updated, suspended, or discontinued.

HabitSpark may suspend or terminate access to the app or website at any time, for example for technical, legal, or operational reasons.

Governing law

These Terms are governed by the laws of the Czech Republic, except where mandatory consumer protection laws in your country of residence require otherwise.

Website and support

The HabitSpark website is provided to share product information, legal pages, support details, and App Store links. If you contact support, you are responsible for the information you choose to include in your message.

Disclaimers

To the maximum extent permitted by law, HabitSpark and the HabitSpark website are provided on an “as is” and “as available” basis without warranties of any kind. HabitSpark may contain bugs, interruptions, or changes, and it is not a substitute for professional advice.

Nothing in these Terms limits any mandatory consumer rights you have under applicable law.

Limitation of liability

To the maximum extent permitted by law, HabitSpark will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the app or website. Nothing in these terms limits liability that cannot be limited under applicable law.
